By accessing or using this website (the “Site”) or any products or services provided by Elevate Accessibility (“we”, “our”, or “us”), you agree to the following Terms of Service. This Site is provided for general informational purposes only. While we strive to ensure accuracy, we do not guarantee that all content is complete, current, or error-free. Information on this Site may change at any time without notice.

You agree not to use this Site for any unlawful purpose or in any way that could damage, disable, or impair its functionality.


2. Quotes, Estimates, and Pricing

Any pricing, quotes, or estimates provided through this Site or by our staff are for informational purposes only and are subject to change upon a full site assessment.
Final pricing will depend on installation requirements, product availability, building conditions, permit requirements, and other factors.

Quotes do not constitute a binding contract until formally accepted in writing by both parties.


3. Product Information

We install and service a wide range of accessibility equipment, including stairlifts, porch lifts, vertical platform lifts, ceiling lifts, ramps, and home modifications.
Product descriptions on this Site are provided for reference only and may differ slightly from the final installed product based on model availability, manufacturer changes, or project requirements.

We reserve the right to substitute equivalent models or components if necessary.


4. Service and Maintenance

All installations and service work are performed by trained technicians.
Service appointment durations, timelines, and response times may vary. While we strive to provide timely service, we cannot guarantee immediate availability, especially during peak seasons or emergency situations.

Clients are responsible for ensuring safe access to equipment, including clearing snow, ice, debris, clutter, or obstacles prior to technician arrival.


5. Warranties

Product warranties are provided by the manufacturer and may vary by brand and model.
Elevate Accessibility does not provide additional warranties beyond what is offered by the manufacturer unless explicitly stated in writing.

Warranty coverage may be void if:

  • the product is misused or modified

  • unauthorized persons perform repairs or adjustments

  • environmental or site conditions cause damage

  • regular maintenance is not performed as recommended


6. Payments and Invoicing

Payment terms will be detailed in your service agreement or invoice.
Failure to pay may result in suspension of service, collection efforts, and additional fees.

Deposits may be required before ordering equipment or scheduling installation.


7. Cancellation and Refund Policy

Custom-ordered equipment, special-order parts, or items purchased specifically for your project may be non-refundable.

If work has already begun, the client may be responsible for labour, shipping, restocking, or material costs incurred to date.


8. Permits and Compliance

Certain installations require permits or inspections under Manitoba’s building and safety regulations.

Elevate Accessibility will assist with required permits when applicable, but the property owner is responsible for supplying accurate information and ensuring compliance with all municipal, provincial, and federal regulations.

We are not responsible for delays caused by third-party inspectors, permit offices, contractors, or regulatory authorities.


9. Limitation of Liability

To the fullest extent permitted by law, Elevate Accessibility is not liable for:

  • indirect, incidental, or consequential damages

  • delays, service interruptions, or equipment downtime

  • damages resulting from misuse, neglect, or failure to maintain equipment

  • work performed by third-party contractors not authorized by us

Our total liability is limited to the amount paid by you for the service or product that gave rise to the claim.

We are not responsible for the content, accuracy, or policies of any third-party sites.


11. Privacy

Your use of this Site is also governed by our Privacy Policy.
